Terms and Conditions
in plain Black and White
These terms and conditions form the basis for terms of business and are contractually binding in the event of any dispute - 2005 - 2008.
All photography and photographs taken by and stored by Hawthorn DP, are copyright of the photographer unless otherwise explicitly agreed in writing and signed by both parties, to include the customer(s) and the vendor.
Copyright is passed over and released when the photographer / company agrees, no photographs may be reproduced without full credit to Hawthorn DP or the photographer by name, or without his or their permission. Where a fee is involved, reproduction / publication may not take place until the fee is paid in full.
A contract is deemed made when a deposit or fee is paid in respect of all photography, or material is submitted for reproduction.
Ownership of material, including third party negative material is assumed of the customer, they must take all reasonable steps to ensure they own copyright as Hawthorn DP will not be held liable for ensuing court or civil action.
Storage of all electronic material is made for 2 years from date of make, reprint and reorders can be made for this period. However, it is best advised that the customer purchases their own compact disc for future use as insurance, unless included in packages (Weddings / Portraits).
Children who are photographed (under 18), must have the written permission from a responsible adult if unaccompanied - a release form is supplied for these purposes.
Prices:
Prices are inclusive - discounts only apply to fully paid up accounts and will be revoked in the event of the account becoming overdue, this means that any applied discount will be reapplied and added to the invoice / account.
Prices quoted are current. All prices are guaranteed for all customers upon quotation for a period of one calendar month, or from a solid booking being made and deposit being paid.
Payment must be made as follows
Sittings - sitting fee at the sitting
Photograph orders - 50% on order, balance on receipt
Weddings - 50% on booking, balance fourteen calendar days before date of event.
Event photography - payment upon invoice 15th month following / on the day of event
Corporate accounts - full payment within 30 Days (calendar) from the date of sitting or studio booking whichever the sooner.
Rush Orders - all orders requiring same day production will attract a 50% surcharge.
